Member Borrowing AGREEMENT

This agreement governs the borrowing of physical media (DVDs, Blu-rays, 4K and related formats) from Film Club, LLC. By becoming a member and borrowing titles, you agree to the following terms.

1. Membership Fee

A membership fee of $20 (plus tax) is required to open a member account. The membership fee is not a late fee, a security deposit, or a credit toward rentals. It grants access to borrowing privileges. This fee is non-refundable, and membership is contingent upon remaining active and in good standing — meaning all borrowed titles have been returned and no outstanding fees remain.

Accounts with no borrowing activity and no member communication for a period of one (1) year will be considered inactive and will be closed automatically, with no further obligation on either party. As with accounts closed due to delinquency – described in Section 4 – reinstatement requires payment of a new membership fee, to be paid in full before borrowing privileges may resume.

In the event that Film Club permanently ceases operations or significantly changes its operational model — including but not limited to out-of-town relocation or suspension of in-person lending — all active members will be notified. Film Club may, at its discretion, offer a refund of the membership fee to members who paid the fee within the 30 days immediately preceding closure..

2. Rental Terms

•       Standard rental period: 7 days from date of borrowing, unless otherwise stated.

•       Rental fees are due at time of borrowing. Prices are subject to change, but the majority of films rent at $5 per disc (plus tax).

•       A card on file is required for all active members, held securely via Square or equivalent.

•       Rentals can be returned directly to the pop-up, or to The Regulator Bookshop (720 9th St, Durham, NC 27705) anytime during their regular operating hours (Mon-Sun 10-6pm).

3. Late Returns

Titles not returned by the due date accrue a late fee of $1 per day per disc, capped at $20. Outstanding late fees must be settled before any new borrowing. A member account with unreturned titles is placed on hold until all items are returned and the account is brought current.

After 7 days past the due date, Film Club will make one (1) contact attempt via the email address or phone number provided at sign-up. It is the member’s responsibility to keep their contact information current. If no response is received and the title remains unreturned, the account will be closed at 30 days past due, and the card on file will be charged for replacement costs and any outstanding fees.

4. Delinquency & Account Closure

If a title remains unreturned 30 days past its due date, the account will be closed. The notice requirement is considered met upon one (1) documented contact attempt via the member’s contact information on file, as described in Section 3. To reopen a closed account, the member must pay a new membership fee before resuming any borrowing.

Closure of the account due to inactivity or delinquency (failing to remain in good standing) does not constitute full satisfaction of the member’s liability — the member remains responsible for any late fees accrued, and the replacement cost of any unreturned or damaged titles, regardless of account status.

5. Replacement Cost

In the event of loss or irreparable damage, the member is liable for the actual replacement cost of the title. Replacement cost is determined at Film Club’s discretion based on current market value.

For titles that are part of a multi-disc set or box set: individual discs from such sets are rented separately, but liability for loss or damage extends to the full set replacement cost, regardless of how many discs from that set were borrowed. A broken or incomplete set cannot be sold or rented as a complete set; the member is therefore responsible for restoring the set to its complete condition.

This applies to all box sets in Film Club’s collection, including but not limited to special editions, director collections, and multi-volume releases.

6. Care of Materials

Members are responsible for returning borrowed titles in the same condition in which they were received. This includes discs, cases, inserts, and any accompanying materials. Normal wear is expected; damage beyond normal wear is subject to replacement cost as outlined above.

Members agree to handle discs by gripping only the outer rim or the inner center ring. Never touch the shiny, unlabeled data side of the disc, as oils and fingerprints can distort the laser. For safety, always store the disc in its original hard case when not in use. Keep away from direct or prolonged exposure to sunlight.

7. Closing Your Account

To close your account, return all borrowed titles and settle any outstanding fees, then notify Film Club explicitly that you wish to close your account. Should you wish to rejoin at a later date, a new membership fee will apply.

8. Closures

Film Club may observe scheduled and unscheduled closures. Notice of scheduled closures will be posted via Film Club’s social media channels and other public communications in advance. Unscheduled closures may occur without prior notice. Regardless, you will still be able to return your rentals to The Regulator Bookshop during their regular business hours. If The Regulator Bookshop is observing scheduled or unscheduled closures, and your due date falls within that closure period, your closure period will be adjusted accordingly, and no late fees will accrue during that time.
